The licence governing the use and distribution of Tiber software.

1. Introduction
Tiber is proprietary software created and owned by Kanish Shanmuga R. ("Licensor").
The Licensor may authorise Oryvex and other persons or organisations to distribute Tiber on the Licensor's behalf. An authorised distributor may also be given authority to administer certain licensing matters on behalf of the Licensor.
This Licence sets out the terms under which Tiber is made available to you.
By downloading, installing, accessing, or using Tiber, you agree to this Licence. If you do not agree with these terms, please do not use Tiber.
2. Free by Default
Tiber is provided free of charge by default.
Unless different terms are expressly provided for a particular version, distribution, or use, you may download, install, and use Tiber without paying a licence fee.
The Licensor does not, however, make a permanent commitment that Tiber will remain free.
The Licensor may introduce fees or other payment requirements for Tiber in the future. This may include requiring payment for:
- continued use of a particular version;
- future versions;
- commercial use;
- organisational use;
- particular features or capabilities; or
- another category of use specified by the Licensor.
The Licensor may also choose to keep some uses free while requiring a paid licence for other uses.
Any future payment requirement will apply from the effective date specified by the Licensor and will not, unless expressly stated or permitted by applicable law, retroactively make previously authorised use unauthorised.
3. Licence Grant
Subject to this Licence, the Licensor grants you a limited, non-exclusive, non-transferable licence to:
- download and install Tiber;
- use Tiber on systems that you are authorised to use;
- use Tiber for personal, educational, internal, or commercial purposes, subject to any applicable licensing requirements; and
- make reasonable copies of Tiber where necessary for installation, backup, or ordinary use.
This Licence grants permission to use Tiber. It does not transfer ownership of Tiber or any intellectual property associated with it.
4. Duration, Withdrawal, Suspension and Restriction
The licence granted to you is intended to continue indefinitely unless it is withdrawn, suspended, restricted, or terminated in accordance with this Licence.
The Licensor may, subject to applicable law:
- withdraw the licence;
- suspend the licence;
- restrict the licence;
- terminate the licence;
- change the scope of the licence; or
- establish conditions for its continued use.
These actions may be taken in relation to a particular user, organisation, version of Tiber, category of use, or another clearly defined scope.
The Licensor may take such action independently of whether a user has breached this Licence.
Where practical, the applicable notice will identify the scope and effective date of the withdrawal, suspension, restriction, or termination.
Unless otherwise stated or required by applicable law, these changes operate prospectively and do not retroactively invalidate use that was authorised before the applicable effective date.
The Licensor may subsequently reinstate or modify a withdrawn, suspended, or restricted licence.
5. Licensing Authority of Distributors
The Licensor may appoint one or more distributors to distribute Tiber.
A distributor may also be granted authority to administer licensing matters on behalf of the Licensor, including the authority to withdraw, suspend, restrict, or terminate licences where the Licensor has authorised the distributor to do so.
Oryvex is an authorised distributor of Tiber.
Where a distributor has been expressly authorised to exercise a licensing function on behalf of the Licensor, an action taken by that distributor within the scope of its authority will be treated as an action taken on behalf of the Licensor.
The Licensor may confirm, modify, reverse, or replace an action taken by an authorised distributor, subject to applicable law.
6. Distribution Rights
The Licensor may grant distribution rights to Oryvex or to any other person or organisation.
An authorised distributor may distribute Tiber through websites, repositories, download services, installers, mirrors, or other channels approved by the Licensor.
A distributor's authority may be limited by version, distribution channel, geographical area, category of use, duration, or any other terms established by the Licensor.
Distribution rights do not transfer ownership of Tiber to the distributor.
A distributor may not grant rights that exceed the authority given to it by the Licensor.
7. Withdrawal of Distribution Rights
The Licensor retains the right to withdraw, suspend, restrict, or modify the distribution rights granted to any distributor.
This includes the right to withdraw a distributor's authority to:
- distribute Tiber;
- distribute a particular version of Tiber;
- use a particular distribution channel;
- administer licences on behalf of the Licensor; or
- exercise any other authority delegated by the Licensor.
The Licensor may appoint additional distributors or replacement distributors at any time.
The withdrawal of a distributor's distribution rights does not, by itself, determine the validity of licences previously granted to users. The effect on existing user licences will be determined by this Licence, the applicable notice, and any separate agreement or instruction issued by the Licensor.
8. Ownership
Tiber is licensed, not sold.
All rights, title, and interest in Tiber remain with the Licensor, including applicable copyright and other intellectual-property rights.
A distributor's involvement in distributing Tiber does not give that distributor ownership of the Software.
Your use of Tiber does not give you ownership of Tiber, its source code, design, documentation, or associated intellectual property.
Tiber being available without charge does not make it open-source software or place it in the public domain.
9. Redistribution
You are welcome to share information about Tiber and direct others to its official distribution channels.
The licence does not, however, grant permission to redistribute Tiber as a standalone product.
Without permission from the Licensor or an authorised party acting within delegated authority, you may not:
- sell or resell Tiber as a standalone product;
- sublicense Tiber;
- provide Tiber as a separate downloadable product;
- operate an unofficial distribution or mirror;
- repackage Tiber for redistribution; or
- present an unofficial distribution as an official release.
If you would like to distribute Tiber as part of another product, service, or organisational deployment, you may contact the Licensor or an authorised distributor to discuss appropriate permission.
10. Modifications
You may use Tiber as provided under this Licence.
You may not distribute a modified version of Tiber as an official or independently licensed version without permission from the Licensor.
You may not remove or alter copyright notices, licence notices, trademarks, or other proprietary notices included with Tiber.
Nothing in this section is intended to restrict rights that applicable law expressly grants to you.
11. Reverse Engineering
Tiber is proprietary software.
Except where applicable law expressly permits otherwise, you may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying implementation of Tiber.
Nothing in this section is intended to restrict a right that cannot legally be restricted.
12. Third-Party Components
Tiber may contain or depend upon software, libraries, frameworks, or other components developed by third parties.
Those components may be subject to separate licence terms.
Where a third-party licence applies, that licence governs the relevant component.
Nothing in this Licence is intended to remove or restrict rights granted to you under an applicable third-party licence.
13. Your Own Work
Tiber may allow you to create scripts, configurations, data, or other materials.
You retain ownership of materials that you independently create, subject to any rights belonging to third parties.
This Licence does not transfer ownership of your independent work to the Licensor.
You are responsible for ensuring that your use of Tiber and any materials you create with it comply with applicable law and third-party rights.
14. Updates and Future Versions
The Licensor may release updates, improvements, fixes, new features, or new versions of Tiber.
Different versions may have different licensing terms.
The licence accompanying a particular version normally governs your use of that version.
The Licensor may also change, suspend, or discontinue particular versions, features, or distribution channels.
A future version may be provided under a different licence or may be subject to a fee even where an earlier version was available without charge.
15. Responsible Use
Tiber should be used responsibly and in accordance with applicable law.
You are responsible for how you use Tiber and for ensuring that your use does not intentionally violate the rights of others or provide unauthorised access to systems, services, devices, or data.
16. Availability
Tiber is provided on an availability basis.
The Licensor and its distributors may work to maintain and improve Tiber, but cannot guarantee that a particular version, feature, dependency, download, or distribution channel will remain available indefinitely.
The Licensor may modify or discontinue Tiber or any part of its distribution.
17. Disclaimer
To the maximum extent permitted by applicable law, Tiber is provided "as is" and "as available."
The Licensor does not guarantee that Tiber will be completely free of errors, interruptions, or defects, or that it will satisfy every particular requirement or use case.
You are responsible for determining whether Tiber is suitable for your intended use and for maintaining appropriate backups and safeguards for your systems and data.
Nothing in this Licence excludes or limits a right or protection that cannot legally be excluded or limited.
18. Limitation of Liability
To the maximum extent permitted by applicable law, the Licensor and its authorised distributors will not be responsible for indirect, incidental, special, consequential, or similar losses arising from your use of, or inability to use, Tiber.
Where permitted by applicable law, the total liability arising from or relating to Tiber will not exceed the amount you paid for Tiber during the twelve months preceding the event giving rise to the claim.
Where Tiber was obtained free of charge, the total liability will, to the maximum extent permitted by applicable law, not exceed INR 1,000.
Nothing in this section limits liability that cannot legally be limited.
19. Trademarks and Branding
Tiber and associated names, logos, and branding may constitute trademarks or other intellectual property of the Licensor or their respective owners.
Oryvex's use of Tiber branding as an authorised distributor does not transfer ownership of those marks.
This Licence does not grant permission to use Tiber or Oryvex branding in a way that falsely suggests ownership, endorsement, sponsorship, or an official relationship.
20. Severability
If any provision of this Licence is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law, and the remaining provisions will continue to apply.
21. No Waiver
A failure or delay by the Licensor or an authorised distributor in exercising a right under this Licence does not constitute a waiver of that right.
A waiver is effective only where expressly given by the party entitled to give it.
22. Entire Agreement
This Licence sets out the terms governing your use of the applicable version of Tiber.
If you have entered into a separate written agreement with the Licensor concerning Tiber, that agreement will take precedence to the extent of any conflict.
Separate agreements between the Licensor and distributors may define or limit the authority delegated to those distributors and do not, by themselves, grant additional rights to users.
23. Governing Law
This Licence is governed by the laws of India.
Subject to applicable law, disputes arising from or relating to this Licence will be subject to the jurisdiction of the courts located in Chennai, Tamil Nadu, India.
Nothing in this section prevents a party from seeking urgent relief from a court of competent jurisdiction where such relief is legally available.

By downloading, installing, accessing, or using Tiber, you acknowledge that you have read and accepted this Licence.
